1.) CCA FLORIDA’S PROPOSED AMENDMENT
AMENDMENT #3
§ Add the following paragraph to the settlement agreement:
“Notwithstanding any participation in the settlement agreement, the commissioners of the Florida Fish and Wildlife Conservation Commission, individually and severally, in their capacity as constitutional officers, specifically reserve the right to exercise independent judgment on whether to adopt, reject or modify any rules presented to the commission as a result of this settlement or otherwise.”

COMMENT: It is essential to establish a process where all interested parties are given the opportunity to comment, analyze scientific documentation, present concerns, and request changes. The public needs to know and understand that the Commissioners are not already bound to a pre-determined outcome; that changes can and will be made based on public input.
2.) LANGUAGE AS AMENDED IN FINAL SETTLEMENT AGREEMENT
16. As to any rules proposed pursuant to this agreement, the FWCC staff will, in good faith, advocate the proposals; however, the commissioners of FWCC retain full authority to determine whether or not to adopt any proposed rules pursuant to this agreement or to modify such rules and this action shall not constitute a breach of the agreement.
